Sponsor: The Sponsor of the Sweepstakes is Snow Commerce, Inc., 1340 Clay St., Cincinnati, Ohio 45202 United States.

1. Eligibility: This Sweepstakes is open only to those who sign up at  shop.legendary.com/pages/trick-r-treat-halloween-sweepstakes.  and who are (a) 18 years or older, or (b) the age of majority in the state of residence, if higher than 18, as of the date of entry. The Sweepstakes is only open to legal residents of the 49 United States (except residents of Rhode Island) and the District of Columbia, and is void where prohibited by law. Employees of Sponsor, Legendary Licensing, LLC (“Legendary”), and each of their respective parents, affiliates, subsidiaries, advertising and promotion agencies, suppliers (collectively the “Promotion Entities”), and Promotion Entities employees’ immediate family members and/or those living in their same household are not eligible to participate in the Sweepstakes. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations.
   
   
   

2. Agreement to Rules: By participating, the entrant (“You” and “Your”) agrees to be fully unconditionally bound by these Official Rules. You represent and warrant that You meet the eligibility requirements. In addition, You agree to accept the decisions of Sponsor as final and binding as it relates to this Sweepstakes. Sponsor reserves the right, in its discretion, to modify these Official Rules at any time. You are responsible for reviewing and becoming familiar with any such modifications.
   
   
   

3. Sweepstakes Period: Entries will be accepted online starting on October 6, 2025, at 12:01 AM, EDT and ending October 20, 2025 at 11:59 PM, PDT. All online entries must be received by October 20, 2025 at 11:59 PM, PDT.
   
   
   

4. How to Enter: The Sweepstakes must be entered by submitting an entry using the online form provided at shop.legendary.com/pages/trick-r-treat-halloween-sweepstakes. The entry must fulfill all Sweepstakes requirements, as specified, to be eligible to win a prize. Entries that are incomplete or do not adhere to these Official Rules or specifications may be disqualified at the sole discretion of Sponsor. You must provide the information requested. You may not enter more times than indicated by using multiple email addresses, identities, or devices in an attempt to circumvent these Official Rules. You will have one (1) chance to enter the Trick ‘r Treat Sweepstakes using the online form provided at shop.legendary.com/pages/trick-r-treat-halloween-sweepstakes: enter Your email address. The maximum number of entries per person is one (1). If You use fraudulent methods or otherwise attempt to circumvent these Official Rules, Your submission may be removed from eligibility at the sole discretion of Sponsor.

5. Prize: One (1) grand prize winner and one (1) runner-up winner (collectively, the “Winners”) of the Sweepstakes will be randomly selected on October 21, 2025. The grand prize winner will win the following grand prize package: Trick ‘r Treat Sam Horror Babies ($45), Trick ‘r Treat Sam GO! Bobbles ($13.95), Trick ‘r Treat Loungefly Backpack ($90), Trick ‘r Treat Concept One Rope Snapback Hat ($25), Trick ‘r Treat Ben Cooper Sam Action Figure ($22), Trick ‘r Treat Xyrena Extrait de Parfum ($98), and a Trick ‘r Treat Loungefly Glow In The Dark Wallet ($20). The total approximate retail value (“ARV”) of the grand prize is $315.00 USD. The one (1) runner-up winner of the Sweepstakes will win a $50 Legendary Shop e-gift Card ($50). The ARV of the runner-up prize is $50.00 USD. The specifics of the prizes shall be solely determined by Sponsor. No cash or other prize substitution shall be permitted except at Sponsor’s discretion. The prizes are  non-transferable. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of the respective Winners. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by the Winners is permitted. Acceptance of prizes constitutes permission for Promotion Entities to use Winners’ names, likenesses, and entries for purposes of advertising and trade without further compensation, unless prohibited by law. 

 

6. Odds: The odds of winning depend on the number of eligible entries received.
   
   

7. Winner Selection and Notification: The Winners will be selected by a random drawing under the supervision of Sponsor at the end of the Sweepstakes on October 21, 2025. The winners will be notified by email within five (5) days following the selection of the Winners. Sponsor shall have no liability for a Winner’s failure to receive notices due to spam, junk email or other security settings or for a Winner’s provision of incorrect or otherwise non-functioning contact information. If the Winner cannot be contacted, is ineligible, fails to claim the prize within seven (7) days from the time award notification was sent, or fails to timely return a completed and executed declaration and release as required, the prize may be forfeited and an alternate Winner selected at random from among all remaining eligible entries. Receipt by the Winner of the prize offered in this Sweepstakes is conditioned upon compliance with any and all federal, state, and local laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY WINNER (AT SPONSOR’S SOLE DISCRETION) WILL RESULT IN WINNER’S DISQUALIFICATION AS WINNER OF THE SWEEPSTAKES, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.
   
   
   

8. Rights Granted by You: By providing your email address in connection with the Sweepstakes, You understand and agree that Promotion Entities, anyone acting on behalf of Promotion Entities, and Promotion Entities’ licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, Your entry, name, portrait, picture, voice, likeness, image, statements about the Sweepstakes, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, or consent.
   
   
   

9. Additional Terms & Conditions: Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes should virus, bug, non-authorized human intervention, fraud, or other cause beyond Sponsor’s control corrupt or affect the administration, security, fairness, or proper conduct of the Sweepstakes. In such case, the Sponsor may select the Winners from all eligible entries received prior to and/or after (if appropriate) the action taken by the Sponsor. Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Sweepstakes or website or violates these Official Rules. Sponsor has the right, in its sole discretion, to maintain the integrity of the Sweepstakes, to void votes for any reason, including, but not limited to: multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by these Official Rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil laws. Should such an attempt be made, the Sponsor reserves the right to seek damages to the fullest extent permitted by law.
   
   
   

10. Limitation of Liability: By entering, You agree to release and hold harmless the Promotion Entities and each of their respective parents, subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors (the “Indemnitees”) from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such entrant’s participation in the Sweepstakes and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Sweepstakes; (v) electronic or human error in the administration of the Sweepstakes or the processing of entries.  Further, under no circumstances shall You be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than Your actual out-of-pocket expenses (i.e. costs associated with entering this Sweepstakes). You further waive all rights to have damages multiplied or increased.  The Promotion Entities make no warranties, and hereby disclaim any and all warranties, express or implied, concerning any prize furnished in connection with the Sweepstakes.  WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, SUCH PRIZES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, AND THE PROMOTION ENTITIES HEREBY DISCLAIM ALL SUCH WARRANTIES, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND/OR NON-INFRINGEMENT.
    
    
    

11. Disputes: By participating in this Sweepstakes, You agree: (i) that any and all disputes You may have with, or claims You may have against, the Promotion Entities relating to, arising out of or connected in any way with (a) the Sweepstakes, (b) the awarding or redemption of any prize, and/or (c) the determination of the scope or applicability of this agreement to arbitrate, will be resolved exclusively by final and binding arbitration administered by JAMS and conducted before a sole arbitrator in accordance with the rules of JAMS; (ii) this arbitration agreement is made pursuant to a transaction involving interstate commerce, and shall be governed by the Federal Arbitration Act (“FAA”), 9 U.S.C. §§ 1-16; (iii) the arbitration shall be held in Los Angeles, California; (iv) the arbitrator’s decision shall be controlled by the terms and conditions of these Official Rules and any of the other agreements referenced herein that You may have entered into in connection with the Sweepstakes; (v) the arbitrator shall apply California law consistent with the FAA and applicable statutes of limitations, and shall honor claims of privilege recognized at law; (vi) there shall be no authority for any claims to be arbitrated on a class or representative basis, arbitration can decide only Your and/or the Promotion Entities’ individual claims; the arbitrator may not consolidate or join the claims of other persons or parties who may be similarly situated; (vii) the arbitrator shall not have the power to award punitive damages against You or the Promotion Entities; (viii) in the event that the administrative fees and deposits that must be paid to initiate arbitration against the Promotion Entities exceed $125 USD, and You are unable (or not required under the rules of JAMS) to pay any fees and deposits that exceed this amount, the Promotion Entities agree to pay them and/or forward them on Your behalf, subject to ultimate allocation by the arbitrator; (ix) if You are able to demonstrate that the costs of arbitration will be prohibitive as compared to the costs of litigation, the Promotion Entities will pay as much of Your filing and hearing fees in connection with the arbitration as the arbitrator deems necessary to prevent the arbitration from being cost-prohibitive; and (x) with the exception of subpart (vi) above, if any part of this arbitration provision is deemed to be invalid, unenforceable or illegal, or otherwise conflicts with the rules of JAMS, then the balance of this arbitration provision shall remain in effect and shall be construed in accordance with its terms as if the invalid, unenforceable, illegal or conflicting provision were not contained herein.  If, however, subpart (vi) is found to be invalid, unenforceable or illegal, then the entirety of this arbitration provision shall be null and void, and neither You nor the Promotion Entities shall be entitled to arbitrate their dispute.  For more information on JAMS and/or the rules of JAMS, visit their website at www.jamsadr.com.

12. Governing Law, Venue and CLASS ACTION WAIVER: Subject to and without waiving the arbitration provisions herein, this Sweepstakes is governed by California law, without respect to conflict of law doctrines. Unless otherwise provided for by these Official Rules, entrants agree that any and all disputes shall be resolved individually, without resort to any form of class action. In the event the arbitration provision herein is found to be entirely null and void, disputes shall be resolved exclusively before a court located in Los Angeles County, California. 

13. Privacy : By participating in this Sweepstakes, You agree that the Sponsor as the data controller will process Your personal data (full name, email, and information entered during Your entry) in accordance with applicable personal data protection laws. Purposes of data processing include organizing the Sweepstakes, evaluation of Your entry, communication with You, selection of the Winners and awarding the prize. Your data will be processed based on:

    1. Your consent, which You can withdraw at any time by contacting the Sponsor at contact@legendaryshopsupport.com. If You are under 18, You must be able to present Your parents' or legal guardians' express written consent to the processing of Your personal data in accordance with these privacy rules;

    2. the Sponsor’s legitimate interests, such as the  promotion of the Sponsor’s brand and other marketing purposes, as well as detecting fraud, abuse, other malicious activities, and/or enforcing or defending the Sponsor’s legal rights.

Provision of Your personal data is voluntary, but failure to provide the above-mentioned personal data will automatically exclude You from participation in this Sweepstakes. Your personal data will be retained for as long as necessary for the above-mentioned purposes and as long as there is a legal basis for data processing. For example, if You withdraw Your consent, Your data will be deleted, if it is not required to enforce or defend Sponsor’s legal rights. 14. Winners List: To obtain a copy of the Winner’s name or a copy of these Official Rules, mail Your request along with a stamped, self-addressed envelope to: Legendary Shop Trick ‘r Treat Sweepstakes Winners List, Snow Commerce, Inc., 1430 Clay St., Cincinnati, Ohio 45202 United States. Requests must be received no later than October 31, 2025 at 11:59PM, PDT.
